TERMS & CONDITIONS
1. I hereby submit my Distributor Application and Agreement to become an Independent Distributor of SUCCESS INFINITY ENTERPRISES INCORPORATED (herein after referred to as Company). I am applying to become a participating member of the system in order to start availing the benefits and services of entitled member.
2. As a Distributor of the company, I am therefore an Independent Contractor; neither an agent nor an employee, nor a franchisee of the company. I am fully aware that no employee-employer relationship existed between me and the company. I understand and fully agree that I will pay all income taxes, local taxes, and/or local license fees that may arise as a result of my undertakings under this agreement.
3. As a Distributor of the company, I am privileged to participate in the sales and distributions of the company’s goods, receive bonuses and commissions in accordance with the Company’s Compensation Plan.
4. I agree that I am not guaranteed of any commissions/bonuses(Effort basis). I am free to set my own hours and determine my own area of territory of sales and methods of selling, within the parameters of this agreement. I also agree that I am responsible for my own expenses in relation to this distributorship.
5. As a Distributor, I will do my best to observe proper conduct and maintain ethical standards with the highest quality while doing business with SUCCESS INFINITY ENTERPRISES INCORPORATED. The company has the right to terminate the contract agreement of any Business Distributor who will be involved in any misconduct and/or harmful activity against the company.
6. I understand that this agreement does not include the sale of franchise, and that there are no exclusive territories granted to anyone.
7. I shall be subject to sanction as specified in the policies and procedures of the Company’s discretion for the violation or breach of any term or provision of this agreement. Upon the voluntary or involuntary cancellation of this agreement, I shall lose and expressly waive all rights, including property rights to my previous down-line organization and to any bonuses, commissions or other compensation arising from sales generated by me or prior down-line organization.
8. I agree to indemnify and hold the company harmless from any claims, damages, and expenses including attorney’s fees, arising out of my actions or conduct, and of my employees and agents. This agreement is governed and constructed by the laws of the Republic of the Philippines.
9. With this agreement, the company has the right to change any marketing plans, principles, and policies if and when it is deemed necessary.
10. The company reserves the right to amend the composition and value of goods that will form part of the business package of SUCCESS INFINITY ENTERPRISES INCORPORATED due to inflation that will have a direct effect on market prices of these goods.
11. The company shall be entitled to deduct and offset from any commissions, bonuses, or any other money payable to me, any amount past due and unpaid for purchases of the Company’s products and services or any amount in any form owed to the company by me.
12. Signing this application means, I approve to become a Distributor of the company and that this agreement become effective on the date of acceptance by the company, either through original hard copy, facsimile, or email of scanned copy of this agreement for me to be officially considered as a SUCCESS INFINITY ENTERPRISES INCORPORATED distributor. If the company does not receive this form, I understand that this Agreement will be canceled. I also agree that my signature on the facsimile transmittal or email scanned copy be accepted by the company as my original signature. Application must include both front and back of this agreement.
13. I acknowledge that I have read this agreement and agree to abide by and be bound by the terms contained here.
DATA PRIVACY CONSENT
Acknowledging and exercising my rights under Republic Act # 10173 otherwise known as the Data Privacy Act and its implementing Rules and Regulations, I hereby give my consent to SUCCESS INFINITY ENTERPRISES, INC. and its branches/hubs, units, agents, authorized representatives, representative offices, affiliates, subsidiaries, and accredited third-party partners, counterparties, and service providers to process, use and share among themselves the personal information written or encoded on this membership application/registration form, as well as information obtained in the course of my transaction with SUCCESS INFINITY ENTERPRISES, INC. its branches/hub, or units in relation to my membership, or obtained from the third parties for purpose of member identification, risk profiling/assessment, product development and improvement, market research, communications relevant to the transaction made with the company and exercise of function as a member, compliance with SEC rules and regulations, other Rules and Regulations and such other purposes as may be allowed by law.
I also acknowledge that my personal data (refers to ALL types of personal information – personal, sensitive and privileged as defined under then Data Privacy Act and its implementing Rules and Regulations) shall be retained for a period of not less than five (5) years from the time my membership with SUCCESS INFINITY ENTERPRISES, INC. is cancelled or terminated as required or allowed under applicable laws, rules and regulations, unless a longer retention period is necessary in view of any investigation is being conducted, or a criminal, civil, or administrative case has been filed in a competent judicial or administrative body where I or my account is involved or impleaded as a part to the case or investigation, in which cases, to the extent necessary, my Personal Data shall be preserved beyond the five (5) year period until such time that a final judgement has been reached by the judicial or administrative body.
I likewise hereby give my consent to SUCCESS INFINITY ENTERPRISES, INC. and/or its branches/hubs, units, agents, authorized representatives, representative offices, affiliates, subsidiaries, and accredited third-party partners, counterparties, and service providers to offer especially selected products and services to me through email, mail, fax, SMS, or by telephone to ensure that I will have the opportunity to avail of the wide range of products, services and facilities of SUCCESS INFINITY ENTERPRISES, INC. and/or its branches/hubs, units, agents, authorized representatives, representative offices, affiliates, subsidiaries, and accredited third-party partners, counterparties, and service providers.
By clicking the tick box, I constitute my written, express, specific informed consent for any transfer, disclosure or storage, including cloud storage, of my name, address, contact details, account balances and numbers, and other relevant information by and among SUCCESS INFINITY ENTERPRISES, INC. and/or its branches/hubs, units, agents, authorized representatives, representative offices, affiliates, subsidiaries, and accredited third-party partners, counterparties, and service providers.
